The California Appeals Court for the Third District today upheld the trial court and rejected the arguments of the supporters of Proposition 77 for inclusion in the November ballot. Proposition 77 takes the redistricting function out of the hands of the legislature and sets up a mechanism where three retired judges draw the districts without regard to political parties.
Without intervention from the State Supreme Court, which I consider unlikely, the initative will not be on the November ballot.
